On January 19, 2025, the U.S. Court of Federal Claims ruled in favor of Associated Builders and Contractors (ABC) members, declaring that former President Joe Biden's policy mandating project labor agreements (PLAs) on federal construction projects valued at $35 million or more is illegal. This decision responds to 12 bid protests filed by ABC member federal contractors against three federal agencies enforcing the PLA mandates, which were implemented following Executive Order 14063 and a Federal Acquisition Regulatory Council rule effective January 22, 2024. The court's ruling is seen as a victory for taxpayers and the construction industry, particularly benefiting the 90% of the U.S. construction workforce that is nonunion.
